On 29 September 2025, the Tribunal heard Dr Gormsen’s application to amend her claim to introduce the remedy of “user damages”. This is an additional basis for seeking compensation from Meta, which grants compensation on the basis of Meta’s wrongful use of the Class’s property (i.e. their data), even without proving financial loss has been suffered by the Class. Meta opposed this application but were unsuccessful, and the Tribunal ordered them to pay Dr Gormsen’s costs arising from their opposition to the application.
